Terms of Service

The agreement between you and Scale AI Markets, Inc. for use of the GPUaaR platform.

Last updated 9 October 2026

01Agreement to these terms

By creating an account or using the GPUaaR platform you agree to these terms. If you are accepting on behalf of an organisation, you confirm you have authority to bind that organisation, and "you" refers to it.

If you do not agree to these terms, do not use the platform.

02The service

GPUaaR provides accelerated computing capacity on demand. We make the platform available subject to these terms and to the commitments published on our pricing page, which form part of this agreement where they state a measurable obligation.

  • We may change, add, or remove platform features. Where a change materially reduces a commitment you rely on, we will give notice before it takes effect.
  • Availability commitments are measured monthly and reported to you. Where we miss one, the remedy is the service credit described in your plan.
  • Capacity is allocated for as long as your workload holds it and released when you release it.

03Your account

You are responsible for activity under your account, for keeping your credentials secure, and for the accuracy of the information you give us.

  • Keep your sign-in credentials confidential and do not share them.
  • Tell us promptly if you believe your account has been accessed without authorisation.
  • You are responsible for what the people and systems you grant access do with it.

04Acceptable use

You may not use the platform to do anything unlawful, to harm others, or to interfere with the platform itself or with other customers.

  • No unlawful activity, and no infringement of anyone else’s rights.
  • No attempt to gain unauthorised access to the platform, to another account, or to any system reachable from it.
  • No activity that degrades the platform for others, including attempts to circumvent limits or quotas.
  • No use of the platform to send unsolicited bulk communications, or to host or distribute malicious code.

05Your content and your data

You retain all rights in the content and data you bring to the platform. We claim no ownership of it.

You grant us only the permissions we need to operate the service for you: to store, transmit, and process your content as required to run the workloads you ask us to run. We do not use your content to train models.

You may export your data at any time. See the Privacy Policy for how we handle personal data.

06Fees and payment

You pay for capacity while it is in use, at the rates shown to you before you commit. Spend ceilings you set are enforced by the platform.

  • Charges are calculated from measured usage and are visible to you to the hour.
  • Fees exclude taxes, which we add where we are required to collect them.
  • There is no minimum commitment unless you have separately agreed one, and no penalty for stopping.

07Suspension and termination

You may stop using the platform and close your account at any time. On closure we stop billing, release your capacity, and make your data available for export for a reasonable period before deleting it.

We may suspend access where it is necessary to protect the platform, other customers, or to comply with law — for example in response to an active security incident or an unlawful workload. Except where immediate action is required, we will tell you first and give you an opportunity to put things right.

08Warranties and liability

We provide the platform with reasonable skill and care and will meet the commitments we publish. Beyond those commitments and anything your plan states, the platform is provided as is, and we exclude other warranties to the extent the law allows.

Neither party is liable for indirect or consequential loss, or for loss of profit, revenue, or data, except where the law does not permit that exclusion. Nothing in these terms limits liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot lawfully be limited.

09Changes to these terms

We may update these terms. Where a change materially affects your rights we will give notice before it takes effect, and continuing to use the platform after that date means you accept the updated terms.
